Habidesk is an intermediary: the contract is between you and the space owner.
Payments are transferred to the host only after the rental completes without disputes.
Hosts receive legal invoices — Habidesk issues them on their behalf.

1.1. Intermediary nature: Habidesk operates exclusively as a digital intermediary platform (online marketplace) connecting space hosts with persons seeking to use or rent those spaces.
1.2. Not a party to the rental: Habidesk is not a party to any rental agreement, sub-lessor, or accommodation service provider. The physical condition, safety, legal compliance, and actual state of listed spaces are the sole responsibility of the Host.
1.3. Commission agent model: In processing payments, Habidesk acts as a commission agent (pursuant to Art. 71 of the Lithuanian VAT Act) — collecting payments from Renters in its own name and organising fund transfers and invoice issuance.
2.1. One account: Each User may hold only one personal account. The account is personal and may not be transferred to third parties.
2.2. Role switching: The same User may act both as a Renter and as a Host.
2.3. Separation of identity and billing data: The User's personal data is managed in account settings. The Host's business/taxpayer details are managed in a separate Host profile, required for self-billing and DAC7 reporting.
3.1. All payments are processed through the certified partner Stripe, Inc. Habidesk does not store full payment card data.
3.2. The Renter pays a 2% platform fee in addition to the base price.
3.3. Habidesk deducts a 10% commission from the Host's base rental amount (unless an individual rate has been approved).
3.4. The Host's payout is transferred within 1 business day after the end of the visit, provided no formal dispute has been submitted.
4.1. By registering as a Host and accepting these Terms, the User grants Habidesk an irrevocable legal mandate to issue VAT invoices and credit notes on the Host's behalf (in accordance with Lithuanian VAT Act provisions).
4.2. The Host undertakes not to issue advance independent invoices to the Renter for transactions conducted through Habidesk. Invoices generated through the platform are legally valid primary accounting documents.
5.1. Pursuant to EU Council Directive 2021/514 (DAC7), Habidesk is required to collect and verify Hosts' billing and taxpayer data (tax ID, personal ID, company registration number, date of birth, account number, address).
5.2. If a Host's total payouts exceed EUR 2,000 or the number of transactions exceeds 30 in a calendar year, Habidesk is required by law to report this data to the State Tax Inspectorate (STI). The Host is required to provide accurate data.
6.1. Dispute deadline: The Renter has the right to submit a formal dispute within 24 hours of the end of the visit. After this deadline, the payout is released to the Host and disputes will not be accepted.
6.2. Minimal platform intervention: Habidesk acts solely as an intermediary and does not undertake to resolve the substance of disputes. In the event of a dispute, the parties resolve it independently. Habidesk may temporarily withhold the payout until the parties provide evidence of a settlement or court order.
6.3. "No refund" policy: no refund is issued under any circumstances.
6.3. "Flexible" policy: free cancellation at least 24 hours before the start. Cancelled later — no refund.
6.3. "Moderate" policy: free cancellation at least 72 hours before the start. Cancelled later — no refund.
A booking cancelled at the Host's initiative guarantees a full refund to the Renter. All refunds are processed through Stripe within 5–10 business days.
7.1. In the event of a claim arising from Habidesk's fault, the maximum compensation to the User is equal to the amount the User paid as platform fees during the preceding 12 months.
7.2. The platform is not liable for any indirect losses, lost revenue, or business interruption.
8.1. These Terms are governed by the law of the Republic of Lithuania. All disputes shall be resolved through negotiations, and failing that — in the courts of the Republic of Lithuania.
